1.1 The use of personal data by Reformer Club GmbH (HRB 295186), based in Germany at Elsässer Straße 28, 81667 Munich, is governed by applicable legal provisions and by the consent granted by the user for the use of their data.

1.2 Reformer Club GmbH operates Reformer Pilates studios. Through Reformer Club GmbH, various services and products in the field of sports and leisure (together the “sports offering”) can be booked, reserved, or purchased. The sports offerings are provided by Reformer Club GmbH directly. The subject of the contract is the use of the services of Reformer Club GmbH (the “service”). Use of the services of Reformer Club GmbH is carried out by users (the “user”).

1.3 Reformer Club GmbH is aware that the protection and careful handling of users' personal data is very important. Because data protection is a high priority at Reformer Club GmbH, the company strictly complies with applicable legal provisions in Germany (GDPR, Telecommunications Act) when using this data.

1.4 Users are advised to review the General Terms and Conditions (GTC) of Reformer Club GmbH regarding the subject matter of the contract, user obligations, liability limitations, and numerous other important items on the Reformer Club GmbH website at www.reformer-club.com.

2. Collection of Data

2.1 Reformer Club GmbH collects and stores any information that the user provides on the Eversports platform (“Eversports”) and that is transmitted to Reformer Club GmbH in the course of an online booking, or that the user otherwise makes available to Reformer Club GmbH, for example on site. Reformer Club GmbH uses the user's personal data to the extent permitted by law and otherwise only with the user's consent. Where consent is declared electronically in the course of an online booking via Eversports, Eversports complies with statutory information obligations and records this consent using appropriate technical systems.

2.2 Reformer Club GmbH uses the following personal data of the user, where provided: name, email address, phone number, gender, date of birth, profile pictures, place of residence, booking data, existing products.

3. Purpose of Data Use

We process your data in the context of contract performance for the following purposes:

To carry out reservations and store open products.
To create invoices.
To create a booking history.
To communicate notifications regarding the booked appointment.
For email communication if subscribed to the newsletter.

You may object to these data processing activities. An objection means that we will no longer process your data for the above purposes from that point onward. Please note that Reformer Club GmbH services cannot continue to be used after an objection and that the studio Reformer Club profile must be deleted. 3.2 If you have subscribed to our newsletter, we process your data to send our newsletter. You can cancel your newsletter subscription at any time directly via the link in newsletter emails or by email to: train@reformer-club.com.

3.3 We store your data for the duration of the contractual relationship. By default, Reformer Club profiles including user profile data are deleted after 2 years of inactivity and without a valid product (e.g. 10-class pass, subscription, etc.) following the last booking. Data contained on or required for invoice creation is retained longer due to statutory retention periods. After the retention period expires, this data is also deleted.

4. Data Security

4.1 For data security reasons, personal data is stored in a closed system (Eversports) and protected with a password.

4.2 Eversports is a data processor for Reformer Club GmbH and has taken appropriate measures to ensure data security (see: https://www.eversports.at/h/security).

4.3 If Reformer Club GmbH becomes aware that user data has been used systematically and seriously unlawfully and the user is at risk of harm as a result, Reformer Club GmbH will inform the user without undue delay.

4.4 The Reformer Club GmbH website contains links to other services or websites. Reformer Club GmbH is not responsible for the privacy policies and/or procedures of other websites. If the user follows a link to another website, the user is solely responsible for familiarizing themselves with the privacy policy of that other website. The privacy policy of Reformer Club GmbH applies only to information processed by Reformer Club GmbH.

4.5 In addition to Eversports, Reformer Club GmbH uses further data processors for this data processing. We pass your data to the following additional recipients or categories of recipients:

Software providers for booking processing, product management, and cash register systems
Communication tools for customer communication
External hosting providers for data storage

Your data is processed within the EU or EEA. The adequate level of protection results from an adequacy decision of the European Commission pursuant to Art. 45 GDPR.

5. Use of Cookies

We use the “IP anonymization” function on this website. For on-site bookings, the user confirms by signing the privacy provisions on site that they have read the privacy provisions of Reformer Club GmbH. The user acknowledges that the personal data mentioned in section 2.2 is used for the purposes mentioned in section 3.
